Representative Cases

I focus on litigation, but I have also assisted clients with compliance questions, analyzing and developing proposed legislation, and assessing the effects of newly enacted legislation. Some of my cases are described below.

  • Obtaining a dismissal of a putative class action challenging a hospital's charges for services and successfully defending it on appeal. MacNeil v. Crestview Hospital Corp., 292 So. 3d 840 (Fla. 2020)

  • Defending a manufacturer against a putative class action seeking more than $1 billion in damages. Papasan v. Dometic Corp., 2019 WL 3317750 (S.D. Fla. July 24, 2019).

  • Leading a bipartisan coalition of states in challenge to EPA action under the Clean Air Act before the D.C. Circuit Court of Appeals.

  • Representing the Florida Legislature and individual representatives in federal and state litigation.

  • Representing Florida against Georgia in an inter-state dispute over water rights before the U.S. Supreme Court. 

  • Obtaining a unanimous Florida Supreme Court decision for the Florida Department of Revenue in a case seeking to invalidate a state tax and obtain more than $1 billion in refunds and defending the decision at the certiorari stage before the U.S. Supreme Court. Fla. Dep't of Revenue v. DirecTV, Inc., 215 So. 3d 46 (Fla. 2017), cert. denied sub nom. EchoStar Satellite, L.L.C. v. Fla. Dep't of Revenue, 138 S. Ct. 645 (2018).

  • Defending Florida statutes preempting local regulations against constitutional challenges. Florida Retail Federation, Inc. v. City of Coral Gables, 282 So.3d 889 (Fla. 3d DCA 2019); City of Miami Beach v. Florida Retail Federation, Inc., 233 So. 3d 1236 (Fla. 3d DCA 2017).

  • Defending an English solicitor against conspiracy allegations related to alleged computer hacking. Sargeant v. Maroil Trading Co., 2018 WL 3031841 (S.D. Fla. May 30, 2018).

  • Obtaining a unanimous decision from the Florida Supreme Court prohibiting slot machines outside two South Florida counties. Gretna Racing, LLC v. Fla. Dep't of Bus. & Prof'l Regulation, 225 So. 3d 759 (Fla. 2017).

  • Defending a state-created compensation fund for birth-related neurological injuries against False Claims Act allegations.

  • Enforcing the State of Florida's tobacco settlement after a manufacturer breached to the tune of tens of millions of dollars annually.

  • Representing a pharmaceutical company in multi-district and state-court litigation against product liability claims for various medications.

  • Advising state officials on election-administration issues.
